COVID Lawsuits are Spreading: What You Can Do to Protect Your Company

Tuesday, October 27, 2020 at 1pm ET           Duration: 60 minutes

The Covid-19 pandemic hasn’t gone away. But the lawsuit frenzy has begun.
Workers and their attorneys are flooding the legal system with legal actions against companies. For example:

  • Customers or clients blaming companies for failing to take appropriate protective measures to stop the spread when they become ill
  • Wrongful death claims from infected employees and relatives
  • Workers suing their own company when customers attack them for trying to enforce COVID safety rules they are required to enforce
  • Lawsuits over denied COVID leave under new federal paid leave laws
  • Whistleblower claims that employers ignored safety and punished complainers
  • Claims that employers violated employee rights by forcing them to comply with Covid safety rules (more details below)

* Approved for 1.0 recertification credit hour through HRCI & SHRM.

WHY ATTEND

Because this is the latest employment law minefield.
Not sure you’re doing enough to protect employees and customers? Worried that the rules you follow are the wrong ones? Want to prevent needless lawsuits over office openings, telework and COVID infections? To help you understand your obligations during a pandemic, we’ve teamed up with employment law attorney and workplace expert Anniken Davenport.

This webinar will explain everything you need to know about preventing COVID lawsuits and answer questions about specific potential situations.

LEARNING OBJECTIVES

You’ll learn:

  • Which rules to follow (CDC, OSHA, state and local health department rules) and which to adopt as best practices.
  • Why protecting workers identified as “vulnerable” by the CDC can backfire and land you smack in the middle of an ADEA age or ADA disability lawsuit.
  • How careless infection control can mean more than a workers’ compensation death or lost wage claim. It can spiral into a wrongful death claim for relatives or others in close contact with your employee. And that may mean a runaway jury award.
  • Why you should monitor worker health – but not the wrong way. Demand the wrong test and you may be in court fast.
  • Shutting down? There’s a wrong way to do it and a right way. The wrong way leads to lawsuits.
  • Opening back up? Learn what OSHA says about what systems must be checked, cleaned and updated.
  • How mass telework has sparked a lot of litigation and how to do it right without breaking rules in pay, hours worked and exempt classifications.
